thats just...not right. if they asked me for my game back i wouldnt give it to them. it is MY cd.

You own the bit of plastic that they've used to transfer the software to you, that's fine. But you don't own any rights to the software contained on that media, and hence you can only use it in accordance with the EULA that you agreed to when you installed the game.
