I updated the first post with the last email I received regarding this. I especially love this part:

So I should remove every video of every game I have? Atari, Turn 10, Namco Bandai haven't bothered me about these, why does Take 2 and why in such a manner like this?

I think it has something to do with people playing gta before the game was out and now they are just pulling anything gta as when you search forza and tdu loads come up but then saying that loads of gta vids com up.

Stupid idea, can't you host your own vids on here and only post a few on youtube (or an equivilant site) as teasers or would the bandwidth be to much (i dont know much about this side of things)

So why are there still over 30,000 GTAIV videos on youtube?

I feel this is going to be a long battle. I hope it's not Take 2 doing another publicity stunt *cough* "hot coffee" *cough*. I'm sure they have enough money from sales by now.

So every screen capped gaming video on Youtube is actually against copyright regulations? That's gotta be in the region of hundreds of thousands, if not millions of videos. And do any other companies care. No!

And making a video isn't exactly copyright infringement in my view, it's showing what you can do in a game for people to watch, and maybe buy the game themselves, so in effect it's free advertising for Take 2. Can you shoot yourself in the foot on GTA4? Maybe they should add that feature...

Thats compleatly stupid, this is just bad PR for them, I always though of Take 2 as a nice company, one of the better ones but now that view has compleatly changed. Can't really blame youtube really, they need to do somthing is companys are onto them about copywrite, it is the law after all. Dam take2, your videos were great.

Take 2 are so full of their own excriment, please, the internet is supposed to be free speech... my ass.

the media is a money whore, nowadays they will sue anyone who does anything, as a bassist i get very pissy when music companies take down tabs for songs, because its infringing on copyright laws... yeah, maybe they will realise some day that without people playing songs they like, there will be less musicians around for them to make money from in 10 years >.>

Cheers guys, it's strange now that 7diab is gone, I don't have the youtube comment emails on Shelby Fun or Pagani Zonda Roadster, no messages asking me if their PC will run TDU or where they can find it to buy etc.

One comfort is I have EVERY (apart from Lotus Gears, don't know where that went) video I made even from the 1st demo back in March 2006 believe it or not, which I guess is what started the whole diab video thing off. :D

Who remembers this?

Also doing my routine check of TDU media on youtube I laughed when I saw the "Also try" section showing "lotus", "shelby" and "fun".

if im right, Take2 were the people who made GTA IV? correct me if im wrong but how come they got you disabled if you included all the correct copyrights and everything?

You can't just stick a copyright notice on something in order to copy it yourself :p Putting a copyright notice on something that someone else owns the rights to is much more likely to appease them but it's not a guarentee that they'll then waive the right in your instance.

As for different games.. well thankfully most games don't have a clause about ownership of screenshots/game footage. Which if you think about it is fair enough - you are the one playing the game, so you should really have permission to use footage of that. However it has been put in a couple of pieces of software before - I think it was even in Vista once upon a time, that technically MS own the rights on any screenshots/media taken etc.

I would guess that some of this has come about as a result of the accountability some companies are now facing from the courts - if someone uses your game to act out some offensive scene and posts a video of it, the game makers are being held responsible (see hot coffee). By asserting rights to the media they can reduce the risk of that occuring.

Considered using ffmpeg/flvtools/flowplayer and host them somewhere yourself? You could then restrict access to them.

I doubt YouTube will budge on their policies, since they got so much flack in the beginning about hosting copyrighted content.

Your videos Diablo are all over the net just google 7diab. You Tube should send you money not ban you, look at all the people that have watched your videos.

I for one signed up after watching your videos and I'm sure a lot more signed up too. Even if they didn't sign up all the clicks must be worth something. I'll be adding all this to the email I send to them.

I'll also be adding they must give you time to take your GTAIV videos down not just ban you. It's crazy how they think you can remove the videos when you can't get to your account.

They are breaching their terms and conditions as this is your first "breach" of the "Take 2's" "New" copyright terms.

Edit: after checking to be 100% correct on this I found something that may hinder than help you if we all send emails. This just gets worse.

My friend shouldn't have been suspended.

Some users attempt to "campaign" for friends or users who they feel have been suspended without due process or reason. Though we appreciate your opinions, ultimately it is up to the user themselves to appeal their suspension. Please note that we don't accept third-party appeals on behalf of suspended users. Such reports distract from other, potentially larger issues that we may have to deal with on the site and don't have an affect on the outcome of the user's appeal. Please refrain from sending these and encourage users who you feel may have been wrongfully suspended to appeal directly to us.

7. Account Termination Policy

A. YouTube will terminate a User's access to its Website if, under appropriate circumstances, they are determined to be a repeat infringer.

B. YouTube reserves the right to decide whether Content or a User Submission is appropriate and complies with these Terms of Service for violations other than copyright infringement, such as, but not limited to, pornography, obscene or defamatory material, or excessive length. YouTube may remove such User Submissions and/or terminate a User's access for uploading such material in violation of these Terms of Service at any time, without prior notice and at its sole discretion.

I had a similar problem with my account, also suspended.... But with no reason ! oO Seriously, i didn't receive any warning message from youtube about infraction, and suddenly, account suspended ! I sent a mail asking why, the answered me "because you make too much infractions" or something like that... but I didn't made any ! I only upload personal video, so I didn't understand, i asked details, but the didn't answer anymore.... I'm really angry about that...
